Terms of Service

Welcome to Total Guard. These Terms of Service ("Terms") form a binding agreement between you and Total Guard ("Total Guard," "we," "us," or "our") and govern your access to and use of our websites, web app, browser extensions, mobile apps, and related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and account

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a Total Guard account. By using the Service you represent that you meet this requirement and that the information you provide is accurate. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized access.

2. License to use the Service

Subject to your compliance with these Terms, Total Guard grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. We reserve all rights not expressly granted.

3. Acceptable use

You agree not to:

  • Use the Service to violate any law or to infringe the rights of any person.
  • Submit identifiers (such as email addresses or phone numbers) that you do not have authority to submit.
  • Attempt to access the Service through any means other than the interfaces we provide, or interfere with or disrupt the Service.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service except as permitted by applicable law.
  • Use the Service to send spam or to impersonate any person.
  • Resell, sublicense, or otherwise commercialize the Service without our prior written consent.
  • Probe, scan, or test the vulnerability of any system or network without our prior written consent.

4. Third-party services and sign-in

The Service may include or rely on third-party services, including Google Sign-In, payment processors, breach-data providers, broker-removal vendors, and SMS/email delivery services. Your use of those third-party services is subject to their terms and privacy policies, and Total Guard is not responsible for them. If you sign in with a third-party identity provider, you authorize us to receive the limited account information described in our Privacy Policy.

5. Subscriptions, free trial, billing

Some features are available only with a paid subscription. We may offer a free trial; if you do not cancel before the end of the trial, you authorize Total Guard (or its payment processor) to charge the recurring fee for the plan you selected. Subscriptions automatically renew until canceled. Prices and plans may change; we will give reasonable notice of material changes before they take effect for your subscription.

6. Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then. Except where required by law, fees already paid are non-refundable. If a refund is required by applicable law, we will issue it through the payment method originally used.

7. Your content and identifiers

You retain ownership of the information you submit to the Service. You grant Total Guard a worldwide, royalty-free license to use, copy, transmit, store, and process that information solely as necessary to operate, secure, and improve the Service and to provide it to you. You represent that you have all rights necessary to grant this license.

8. Intellectual property

The Service, including its software, design, content, and trademarks, is owned by Total Guard or its licensors and is protected by intellectual-property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Total Guard does not guarantee that the Service will detect every breach, exposure, scam, or threat, that data-broker removals will be permanent, or that the Service will be uninterrupted, secure, or error-free. The Service is not a substitute for your own security practices, anti-virus software, professional legal advice, or identity-theft insurance, except where explicitly offered as part of a paid plan.

10. Limitation of liability

To the maximum extent permitted by law, Total Guard and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid Total Guard in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Total Guard and its affiliates from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the Service is no longer commercially viable. On termination, sections of these Terms that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.

13. Changes to the Service or these Terms

We may modify the Service from time to time. We may also update these Terms; if we make material changes, we will notify you through the Service or by email before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction. If you are a consumer in a jurisdiction whose law grants you rights to bring proceedings in your home jurisdiction, this section does not override those rights.
